Can You Send Cracker Gifts Across State Lines?

A cracker box that is perfectly legal to buy, hold and burst in one state can land as an unusable gift in another, and the difference has nothing to do with how it travels. Getting a consignment from Sivakasi to a recipient's city is a transport question, covered separately in why you cannot courier crackers as a gift; whether that recipient can legally open the box and burst what's inside once it arrives is a destination question, and the two do not track each other. Delhi is the clearest example. The Delhi government imposed a complete year-round ban on the manufacture, storage, sale and use of all firecrackers, including green ones, starting 1 January 2025, and extended it for a period to NCR districts of Haryana, Uttar Pradesh and Rajasthan, per reporting from All India Radio News. A box gifted from a state with no such restriction arrives there as dead weight the recipient cannot legally burst, at least not without checking that year's order first. That gap between "can it travel here" and "can it be used here" is what this page works through.

The Destination Decides

Firecracker law in India runs on two layers, and gifting only works if you check both. The national floor comes from the Supreme Court's judgment in Arjun Gopal v Union of India, dated 23 October 2018 (Writ Petition (Civil) No. 728 of 2015), which restricted lawful manufacture and sale nationwide to green, reduced-emission crackers and banned high-pollution categories such as joined "laris" crackers and anything containing barium salts. In November 2023 the Supreme Court clarified that these directions apply across every state, not to Delhi-NCR alone. On top of that national floor sits a second layer that varies by place and by year: individual states, union territories and city pollution-control bodies issue their own seasonal notifications, and some go further than the national baseline rather than simply repeating it. The National Green Tribunal's orders of 9 November and 1 December 2020 (O.A. No. 249/2020) are the model for how this second layer works: only green crackers may be sold or used, within a two-hour festival window, in places where average air quality is "moderate" or below, and a full ban on sale and use of all firecrackers applies where air quality is "poor" or worse. A gift box does not know which layer applies to its recipient. The sender has to check.

Where Restrictions Apply

Delhi-NCR is the sharpest current example of a locality going beyond the national floor, and it is worth understanding in some detail precisely because it shows how fast the position can move within a single season. Delhi's year-round ban on all firecrackers, including green ones, took effect from 1 January 2025 and was extended for a period to neighbouring NCR districts, per All India Radio News. Yet a Supreme Court order reported in October 2025 relaxed that position for that season specifically: sale of NEERI-listed green crackers in Delhi-NCR was permitted for a short window of only three days at designated locations, and bursting itself was confined to two narrow daily slots, one in the early morning and one in the evening, on the day before and on Diwali day itself, according to SCC Online's reporting on the order. The same relaxation reaffirmed that there could be no sale or purchase of firecrackers through e-commerce networks even during that permitted window, and that anything containing barium, or not NEERI-approved as green, would be confiscated on sight regardless of when it was found. That is the pattern to expect generally, not a one-off: a locality's rule for the 2026 Diwali season can tighten, loosen or stay put compared with the year before, and the only way to know which is to check that season's notification rather than assume last year's still holds. This page will not attempt a current state-by-state list for that reason; a list like that goes stale the moment a state government issues a fresh order, and a stale list is worse than no list. What we can say with confidence, sourced to the facts above, is that restrictions are reissued on a seasonal basis, vary by state and by city air quality, and that Delhi-NCR in particular has repeatedly gone further than the national baseline. Checking Before You Buy

The practical fix is to check the destination before you choose the box, not after. Three checks matter, and they belong in this order.

  1. Confirm the recipient's state and city, not just the state they're registered to or the address on file, since city-level air-quality notifications under the National Green Tribunal framework can be stricter than the state position around it.
  2. Confirm whether that state or city has issued anything beyond the national floor for the 2026 Diwali season, using the state cracker rules tracker rather than memory of a previous year, given how much Delhi-NCR's own position has moved between seasons.
  3. Confirm what's inside the box is genuinely NEERI-certified green stock, since that is the only lawful category nationwide since the 2018 Arjun Gopal order. Genuine certified crackers carry a CSIR-NEERI logo and a QR code on the packaging that a phone camera or the CSIR-NEERI Green QR Code app can scan to pull up licence and approval details; a box whose code does not resolve to that information is not a lawful green-cracker gift, wherever it's headed.
