How to Get a Crackers Dealership in Your District
What a cracker dealership involves: the licence class, the supplier relationship, minimum volumes and the district approvals that decide if you trade.
Most people who search this phrase are picturing a franchise: pay a fee, get a signboard, sell under a brand name, done. That model does not exist in the Indian fireworks trade. What you can actually get is a licence to possess and sell fireworks from your own premises, plus a working supply relationship with a wholesaler or manufacturer who will sell to you on trade terms. Nobody grants "dealership rights" in a district the way a fuel company or a courier franchise does. The licence comes from your district authority, the stock comes from a supplier who chooses to deal with you, and the two are separate transactions that happen to look, from the outside, like one thing called a dealership.
That distinction matters because it changes what you should be doing first. You are not shopping for a franchise agreement. You are applying for a licence and building a trade relationship, in that order, and each has its own paperwork.
What a Dealership Is Not
There is no PESO form, no district process and no manufacturer programme called a "dealership" that hands you exclusive rights to sell fireworks in a territory. Fireworks are explosives in law: under the Explosives Act 1884 and the Explosives Rules 2008 made under it, a licence is required for the manufacture, possession, use, sale, transport, import and export of explosives, and that legal definition includes crackers (PESO's Revised FAQ on the Explosives Rules 2008). What that means in practice: the right to sell is a personal, licensed permission attached to you and your premises, not a brand territory you buy into.
The word "dealer" in the trade usually means one of two things. It can mean a distributor who buys direct from Sivakasi manufacturing units and resells to retailers, or it can loosely describe any retailer who has an ongoing buying relationship with a particular supplier. Neither is a franchise. Nobody can sell you the right to be "the" cracker dealer for your town, and any offer that sounds like that is not describing anything the law recognises. What you can look for instead, once licensed, is a straightforward dealership-style supply account with a wholesaler willing to sell to you on ongoing trade terms.
Licensing requirements differ by state and by district and they do change, so treat everything here as orientation rather than legal advice, and confirm each step with your own district licensing authority before committing money.
The Licence You Need
The licence that lets an ordinary shop possess and sell fireworks is Form LE-5, issued under the Explosives Rules 2008. Clause (b) of LE-5 permits, at any one time, up to 100 kilogrammes of manufactured fireworks in the relevant safety class plus up to 500 kilogrammes of Chinese crackers or sparklers (Explosives Rules 2008, Licence Form LE-5). A higher-volume tier of the same form, clause (f), covers manufactured fireworks between 100 and 300 kilogrammes and Chinese crackers between 500 and 1,200 kilogrammes, but that tier is granted by the Controller of Explosives at PESO rather than by your district authority. For the standard clauses 5(a) to 5(e), the licensing authority is the District Magistrate, which is worth knowing because it tells you exactly whose office you are dealing with: not PESO, not a state industries department, the district administration.
Applications now go through the National Single Window System online, alongside the requisite documents and fee, and district authorities process them through the Licensing System for District Authorities module on the PESO site (PESO Revised FAQ). A standard licence, once granted, can run for one to five years and stays valid until 31 March of the licensed year; renewal must be filed online by that date, and the system stops accepting renewals after 30 September, after which a late application is treated as a fresh licence rather than a renewal. Miss six months past expiry entirely and the licence is cancelled outright, meaning you start over with a fresh No Objection Certificate from the district.
Two structural points catch first-timers out. Since a 2019 amendment (Rule 101(5)) a single licence cannot cover both "use" and "sale" from the same magazine, so you specifically need a possession-for-sale licence like LE-5, not a possession-for-use one. And only the "occupier" can sign the application: the proprietor for a sole proprietorship, a partner nominated in writing by the other partners, or a director nominated by the board. If that person dies, becomes insolvent or loses capacity, an individual's licence is automatically cancelled under Rule 123, while a partnership or company can nominate a replacement occupier and keep the licence alive. What a Supplier Expects
Once you hold a valid sale licence, the second half of "getting a dealership" is persuading a wholesaler or manufacturer that you are worth supplying at trade terms. This is a commercial relationship, not a regulatory one, and suppliers evaluate it accordingly.
A licence is table stakes, not the whole conversation. A supplier who ships bulk fireworks needs to know your licensed possession limit, because that caps how much stock you can legally hold at once. Under Rule 74 of the Explosives Rules 2008, storing more than your licence permits is a violation; the rule allows only a strictly time-boxed exception of up to one-third excess quantity for a maximum of 15 days in genuinely unavoidable circumstances, and that is not a workaround for routine over-ordering (PESO Revised FAQ). A supplier who knows your LE-5 clause and quantity band can plan a dispatch that actually fits inside your magazine.
Beyond the licence, a supplier is weighing your ability to take delivery and pay reliably. Practically, that means:
- A GST registration, since fireworks (HSN code 36041000) attract 18% GST, and any consignment valued above the e-way bill threshold needs that document generated online before the goods can move (ClearTax on e-way bills).
- Premises that can physically receive a road consignment. Fireworks are Class 1 dangerous goods and move only by road, never by air or standard courier, so your shop or godown needs vehicle access, not a mailing address.
- A track record or at least a credible first order size, since manufacturers and wholesalers typically deal on a commission or margin basis and have no reason to prioritise an unknown buyer over an established one.
None of this is administered by any authority. It is the ordinary judgment a supplier makes about any new trade customer, and it is the part first-timers underestimate because the licence process feels like the hard part. It usually is not.
Starting the Relationship
There is no application form for "becoming a dealer." What actually starts the relationship is straightforward, in this order: secure and fit out compliant premises, obtain your LE-5 sale licence from the district, register for GST, and then approach a wholesaler or manufacturer with your licence details and the volume you intend to move. Reputable suppliers will ask for the licence before they quote, because a legitimate business does not want an unlicensed buyer's stock traced back to their dispatch.
Expect the conversation to be about your licensed quantity band, your location and your payment terms, not about a franchise fee. Most suppliers work to a minimum wholesale order, so know your target volume before you call rather than during the call. Lead times for placing and receiving a bulk order vary by supplier, and because fireworks move only by road under Rule 63 of the Explosives Rules 2008 (transport is permitted only between sunrise and sunset), road transit itself takes multiple days once an order is confirmed. Every road consignment must travel with an indent in Form RE-11 issued by the buyer, a transport pass in Form RE-12 issued by the seller, a copy of the road-van licence, and the original bill. Ask for all four with your first delivery and treat their absence as a warning sign about the supplier, not a formality you can skip.
